In consideration of being allowed to participate in any pickleball-related activities organized by Wishery.org at various locations, I acknowledge, appreciate, and agree to the
following:

 

1. The risks of injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist.

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation. 

3. I affirm that I am physically fit and capable of participating in the pickleball activities and that I have not been advised against such participation by a qualified healthcare provider.

4. I willingly agree to comply with the stated and customary terms and conditions for participation, including abiding by the USA Pickleball Official Rulebook 2025. 

5. In the event of bad weather, unforeseen circumstances, or any other reason beyond the control of Wishery.org, including but not limited to changes in venue, scheduling conflicts, or logistical issues, DLP reserves the right to reschedule events to ensure participant safety and convenience. Refunds will not be issued for rescheduled events, but participants will be notified in advance of any changes and will be offered the opportunity to participate on the new event date or location.

6. To ensure a safe and respectful environment for all participants, I acknowledge and agree that tournament directors reserve the right to ask participants to change if their clothing or attire is deemed inappropriate. Additionally, tournament directors have the authority to eject any participant from the activities without refund if unsportsmanlike behavior is observed. Unsportsmanlike behavior includes, but is not limited to:

   • Aggressiveness: For example, a player forcefully slams their paddle on the court or aggressively confronts another player over a disputed point, disrupting the game's flow and creating a hostile environment.

   • Excessive Cursing: For example, a player repeatedly uses profanity during a match after missing shots or disagreeing with the referee’s call, making others uncomfortable and diminishing the positive atmosphere of the event.

   • Verbal Abuse: For example, a participant insults or yells at their partner or an opponent, calling them names or belittling their abilities, which is disrespectful and not in line with the spirit of friendly competition.

   • Physical Altercations: For example, a player pushes or physically confronts another participant after a heated exchange, which is a serious violation of the conduct rules.

   • Other Inappropriate Actions: For example, a player intentionally tries to distract their opponent during serves or rallies by making loud noises, taunting, or engaging in unsportsmanlike tactics, undermining fair play.

7. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE AND HOLD HARMLESS Wishery.org, its officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”),  WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

IF PARTICIPANT IS A MINOR (UNDER AGE 18 AT TIME OF REGISTRATION), PARENT/LEGALGUARDIAN MUST COMPLETE: I affirm that I am the parent or legal guardian of the above Participant and I have the authority to give this authorization to Participant’s signing of and consent to the above Waiver Agreement. I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS WAIVER AGREEMENT. I understand its terms, including that Participant and I are giving up substantial legal rights. I understand that this Waiver Agreement is a material inducement for Participant’s admission to and continued participation in the Event and that the Event and the other Released Parties are relying upon it. I also agree that no promises, statements or inducements contrary to anything contained in this Waiver Agreement have been made by any of the Released Parties. I acknowledge that the Participant and I have had the opportunity to seek legal advice regarding this Waiver Agreement from a lawyer of my choice.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY
UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY
SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
